Cafform — Terms of Service

Acceptance of terms

These terms govern your use of cafform.shop and every purchase you make from it. Cafform is the trading name of Caffora Limited.

By placing an order through cafform.shop, you agree to these Terms of Service. These terms and our other store policies are made available to you through links at checkout and on our website before you place your order.

Eligibility and age

You must be at least 18 years old and able to enter into a binding contract to order from us. We sell only to customers with a delivery address in the United States (all 50 states and Washington, DC) or Canada.

Accounts

You can order without signing in, or use a customer account to view and manage your order information. Customer accounts use Shopify's passwordless sign-in system. You are responsible for keeping access to your email account secure. Tell us at support@cafform.shop if you believe someone has gained unauthorised access to your customer account, and we will help secure it.

Pricing and price errors

Prices are shown in US dollars and exclude applicable sales tax or GST/HST/PST, which is calculated at checkout. We may change prices at any time; the price that applies to your order is the one displayed when you place it.

Occasionally a price may be published in error. Where a price is obviously wrong — a coffee machine listed at a small fraction of its normal value, for example — we may decline the order rather than fulfil it. If we do, we tell you within 1 business day and refund any amount taken in full within 5 business days. We do not require you to pay the difference, and we do not ship at the wrong price and invoice you afterwards.

Order acceptance and our right to refuse

Your order is an offer to buy. Our acceptance takes place when we ship the machine, not when you pay. Payment taken before shipment is held against a contract that has not yet been formed, and if we do not ship, we refund it in full.

We may decline an order where the item is out of stock, the price was published in error, the delivery address is one we cannot serve, or we have reasonable grounds to suspect fraud. We tell you the reason and refund you within 5 business days.

Payment methods

We accept the payment methods displayed to you at checkout, including major credit and debit cards, Apple Pay, Google Pay and Shop Pay. Available payment methods may vary depending on your location and checkout. Charges appear on your statement as SP CAFFORM. We do not offer instalment or buy-now-pay-later payment.

Taxes

Sales tax (for orders shipped within the United States) or GST, HST and/or PST (for orders shipped within Canada) is calculated at checkout based on your delivery address and shown before you confirm your order. Where we are required to collect it, we do; where we are not, none is added. Tax is never folded into the shipping cost.

Transfer of title and risk of loss

Title and risk of loss pass to you on delivery to the address you gave us.

This does not mean we stop being responsible the moment a carrier records a delivery scan. If a parcel is recorded as delivered and you do not have it, or arrives damaged, we investigate under the procedures in our Shipping Policy and Refund and Return Policy. A delivery scan is evidence, not the end of the discussion.

The Cafform Limited Warranty

This is a Limited Warranty and it is given by Cafform, not by the manufacturer of your machine. Cafform is the warrantor and Cafform bears the cost of honouring it.

Duration: 2 years from the date your machine is delivered.

What it covers: pump failure, boiler and heating element defects, electrical components, and manufacturing faults.

What it does not cover:

  • limescale or scale damage caused by hard water
  • commercial use of a machine sold for domestic use
  • repair or modification by anyone other than a technician we authorise
  • consumable parts, including gaskets, filters and shower screens

How to claim: email support@cafform.shop with your order number and a description of the fault. We confirm whether the fault is covered, arrange the return at our cost, and refund approved claims to the original payment method. You never pay to return a machine under this warranty.

Who it covers: the original purchaser. It does not transfer if you sell or give the machine to someone else.

Implied warranties

Because we give you the written warranty above, we do not exclude or disclaim the implied warranties that apply to your purchase under applicable law, including any implied warranty of merchantability or fitness for a particular purpose. Any statutory rights you have are unaffected by these terms.

Where the law of your state or province permits, the duration of those implied warranties is limited to the 2-year duration of the written warranty above. Some jurisdictions do not allow such a limitation, in which case it does not apply to you. This warranty gives you specific legal rights, and you may have other rights which vary from state to state or province to province.

Limitation of liability

To the extent permitted by law, our total liability arising from an order is limited to the amount you paid for that order. We are not liable for indirect or consequential losses.

Nothing in this section limits liability that cannot lawfully be limited, including liability for death or personal injury caused by negligence, or for fraud. Nothing in it affects the remedies described in our Refund and Return Policy or the warranty above.

Indemnification

You agree to indemnify Cafform against claims arising from your misuse of the site or your breach of these terms. This does not apply to anything caused by us.

Intellectual property

The Cafform name, our site design, our photography and our written content belong to Caffora Limited. Manufacturer names, product names and images belong to their respective owners and are used to identify the machines we sell. You may not copy our content for commercial use without permission.

Force majeure

Where an event outside our reasonable control prevents us from fulfilling an order — a natural disaster, a carrier network failure, or similar — we will tell you, give you a revised date where we have one, and give you the choice of waiting or cancelling for a full refund. We do not use this clause to hold your money indefinitely or to avoid refunding you.

Dispute resolution

If something goes wrong, contact us first at support@cafform.shop. Most problems are resolved quickly and directly, and we would rather fix an issue than argue about it.

These terms do not require you to arbitrate, and they do not waive your right to participate in a class action. Nothing here restricts your right to bring a complaint to a consumer protection agency in your state or province.

Your rights under state or provincial law

These terms do not name a governing law or a chosen forum. Where a dispute arises, it is resolved under the law that ordinarily applies to it.

What that means for you in practice: nothing in these terms limits, waives or replaces the consumer protection rights available to you under the law of the state or province where you live. Those rights apply in full alongside everything written here, and where any term conflicts with them, your local law prevails.

Changes to these terms

We may update these terms. The version in force when you place an order is the version that governs that order — changes never apply retroactively to an order already placed. Each version carries a number and an effective date at the top of this page.
